Terms of Service

By accessing this website, submitting the booking form, or engaging Florida Focus LLC ("Florida Focus," "we," "us," "our") for production services, you agree to these Terms of Service. If you don't agree, please don't use the site or engage our services.

Florida Focus provides video and photography production services, edited deliverables, and monthly content retainers. Specific scope, deliverables, timeline, and pricing for any engagement are defined in the signed contract between Florida Focus and the client. These Terms of Service complement — and do not replace — the terms of that signed contract. If a conflict arises, the signed contract controls.

Some features (viewing project deliverables, paying invoices, managing retainers) require a client portal account. You agree to:

• Provide accurate information when signing up.
• Keep your login credentials confidential.
• Notify us promptly at contact@alexluncan.com if you suspect unauthorized access.

You are responsible for activity under your account.

Payments are processed by Stripe, Inc. Card details are entered directly with Stripe — Florida Focus does not store card numbers on our servers. One-off invoices are billed per the signed contract (typically 50% deposit / 50% on delivery unless specified otherwise). Monthly retainers bill on the agreed day each month via saved card.

Late or failed payments may pause ongoing work or subscription services. Chargebacks initiated without first contacting Florida Focus may result in immediate termination of the engagement and collection of outstanding amounts owed.

Refund eligibility is governed by the signed contract. In general, deposits are non-refundable once work has commenced; completed monthly retainer cycles are non-refundable.

Site content: All content on floridafocus.media — including text, graphics, video samples, logos, and design — is owned by Florida Focus LLC or its licensors and protected by copyright. You may not reproduce, republish, or redistribute it without written permission.

Delivered work: IP ownership of delivered production work transfers to the client upon receipt of final payment, subject to the usage rights defined in the signed contract. Florida Focus retains the right to display delivered work in its portfolio, on its website, and on social media for self-promotional purposes.

You agree not to:

• Use the site or portal for any unlawful purpose.
• Attempt to interfere with, disrupt, or gain unauthorized access to any part of our systems.
• Scrape, crawl, or use automated means to extract data beyond what is publicly served to browsers.
• Submit false information through the booking form or portal.
• Impersonate any person or misrepresent your affiliation with any organization.

We use the following third-party services to operate the site and client portal: Stripe (payments), Supabase (database and authentication), Resend (transactional email), Google Workspace (calendar and cloud storage), and Vercel (hosting and analytics). Your use of the site is also subject to these providers' terms. We are not responsible for interruptions, data handling practices, or errors of third-party services beyond our control.

The site and portal are provided on an "as is" and "as available" basis. Florida Focus makes no warranties, express or implied, regarding uninterrupted access, error-free operation, or fitness for a particular purpose beyond what is set out in a signed production contract.

To the fullest extent permitted by Florida law, Florida Focus's total liability for any claim arising out of or related to these Terms or your use of the site is limited to the greater of: (a) the amount you paid Florida Focus in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100). Florida Focus is not liable for indirect, incidental, special, consequential, or punitive damages.

You agree to indemnify and hold Florida Focus harmless from any third-party claims, losses, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the site or portal.

We may suspend or terminate access to the site or portal at any time for violation of these Terms or any signed contract. You may close your account at any time by contacting us. Termination does not affect obligations for services already rendered or amounts owed.

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising out of these Terms or your use of the site will be resolved in the state or federal courts located in Florida, and you consent to personal jurisdiction in those courts.

We may update these Terms from time to time. Material changes will be posted here with a revised "last updated" date. Continued use of the site after changes means you accept the updated Terms.
